HUSBAND AND WIFE.

OLIVE BRANCH REJECTED. ,i A petition for restitution of conjugal rights came before Mr, Justice Stringer, in the Supreme Court yesterday, the petitioner being William Fallon, solicitor .(Mr. Richmond), and the respondent, Jforah Zilda Fallon. It was stated .that the marriage took place at the Sacred Heart Church, Pon- . gonby, in 1909, and there were no children. Unhappineas that had existed almost from the commencement, came to a head in December. 1919, when the respondent refused the petitioner conjugal rights. Last motth the petitioner wrote a letter to the respondent, in which he said: "I know we all have our failings, but I do not think ours are so serious that they cannot be overcome by a little give and take on each Bide- I think, seein? it is the beginning of a new year, we should make a fresh start and live together again." The respondent replied: "Dear Sir: In reply to yours of January 17, I must state I am leaving New Zealand at an early date, so am unable to avail myself of your Kind offer. Yours faithfully, N. Fallon." A law clerk gave evidence that when he served the papers upon Mrs. Fallon, eh© said : ''That's good." She also stated she had intended to start proceedings herself, but was glad the petitioner had done bo. An order was made for the restitution of conjugal rights within 14 days.
