MAGISTRATE'S COURT.

CLAIM FOR DAMAGES SUCCEEDS. The civil action in which Mr. F. L. Fitchett, barrister, Auckland (Mr. Meredith), claimcd £168 lis damages from the New Zealand Express Company, Ltd. (Mr. McConnell), was concluded in the Magistrate's Court yesterday, before Mr. J. E. Wilson, S.M. In his statement of claim plaintiff said the defendants packed and stored his furniture in their store at Wellington and held it until October, 1917, when they conveyed it to Auckland at plaintiff's instructions. The cases were opened by the defendant company, and many of the contents were found to be broken. When the articles wer« lirst packed they were undamaged, and plaintiff alleged that tho damage, totalling £68 lis, was caused by the negligence of the defendant company. Some of the evidence was heard ill Wellington, and after hearing other witnesses here Mr. Wilson gave judgment for the plaintiff for £60 and costs.
