MAGISTRATE'S COURT.

A cask was heard at the Magistrate's Court yesterday, before Mr. E. C. Cutten, S.M., in which Agnes K. Spihley, of Newton Road (Mr. Vallance), claimed from W. Nelson, of Brown Street, Ponsonby (Mr. Denuiston), the sum of £12, the price of motor tyres sold and delivered to defendant by the plaintiff. For the defence it was disputed that defendant was the user of the car for which the tyres were bought, it being contended that the car had been leased to defendant's son and another who were responsible. Evidence was brought to show that goods had been ordered by and paid for by defendant, but when the account for the amount claimed was presented defendant disclaimed liability. Judgment was given for plaintiff for £13 and £2 18s costs, . Judgment by default, with costs, was given in the following cases:—Sarah A. Fill v Albert Dorricott, Ponsonby, £6 6s; E. Cowan v. M. Cavanagh, Devonport, 12s 9d.
