ACCOUNTS OF AN ESTATE.

SUPREME COURT CASES.

[BT TELEGRAPH.PRESS ASSOCIATION.] Wellington, Tuesday. Two undefended actions, arising out of the settlement of the estate of the late Robert Taylor, farmer, of Timaru, were heard by the Chief Justice at the Supreme Court this morning. In the first action, John Latham (Gore) and James Alexander McGiHivray (Timaru), executors of the will of the late Robert Taylor, sued William Taylor, of Te Kuiti, asking for the taking of accounts and judgment for any sum found to be owing. In the second case, the same plaintiffs sued William Taylor and Hugh Taylor, \ of Te' Kuiti, for £700, moneys alleged to hare been advanced, and interest. Mr. Popplewell, of Gore, appeared for the plaintiffs in each action, and there was no appearance of the defendants. Mr. Pocplewell said that from a conversation he had had with Mr. Cooper, who had been acting for the defendants, he underetood they had abandoned their defence altogether, and the same applied to the counter-claims which liad been filed in each case. Unfortunately the financial position of the defendants was not strong, and he feared that they were taking some other course. There being no appearance of defendants, he asked for judgment. ~ In the first case, His Honor ordered that accounts be taken before the registrar, le.ave being reserved to the plaintiffs to move for judgment on the accounts. The counter-claim was dismissed, and the question of costs was reserved. In the second case, judgment was given for plaintiffs for £700, with interest at the rate of 7 per cent, from June 6, 1912 and costs according to scale, with witnesses expenses and disbursements. The counter-claim in this case was also dismissed. ••
