JURY DISAGREE.

NEW TRIAL ORDERED.

An elderly married woman named Jessie Armstrong was charged before His Honor Mr. Justice Cooper in tho Supreme Court yesterday. with illegally using an instrument. Tho Hon. J. A. Tole, K.C., appeared for the Crown, and the accused, who pleaded not guilty, was defended by Mr. W. E. Hackett.

The prosecution alleged that on March 20 last a young unmarried girl paid a visit to the accused in order to' have her fortune told. The accused noticed that the girl looked worried, and suggested the cause. The accused, it was further alleged, performed an illegal operation upon the girl, who was then sent to a- private nursing home. The girl became ill, subsequently recovering. No evidence was called for the defence. Mr. Hackett addressed the jury at some length, maintaining that the Crown had net proved tho case. The jury, after deliberating for nearly five hours, intimated that there was no prospect of an agreement being reached. His Honor, therefore, discharged them, and ordered a new trial. This will, if possible, take place this session, at the conclusion! of the other business.
