PRISONERS ACQUITTED. teleokaph.—press association.] ; :' Hokitika, Thursday. The OCira robbery . case was heard at the Supreme Court to-day. When the jury assembled this morning it was announced that one juryman had been taken ill at his residence, and was tumble to "■- bo present. Counsel on both sides tiled an agreement, signed by the Crown Prosecutor, both accused, and both counsel, agreeing to accept the verdict of the* remaining 11 jurymen. This course was taken under "the Crimes Act, 1908, passed recently. When evidence .for the Crown closed counsel for defendants asked His Honor if the case need go before the jury. The judge replied that it was exceedingly weak, but he would not undertake the responsibility of withdrawing it from the jury. He left it. to the jury themselves to decide whether they, desired to hear the defence of the accused. The jury : decided to acquit accused, without calling on the defence. The prisoners were then discharged.
