responsibility of settlers. [BY .TELEGRAPH. —OWN: CORRESPONDENT.] Dabgavillk. Friday. Ax important case has occupied the attention o£ Mr. Dyer. S.M., for two days. J. Brown sued a neighbour, Chas. Kerr, for £492 damages "by fire alleged to have been lit by defendant in February, which resulted in burning over 100 acres of grass, timber, fencing,' and a house. There were over 25 witnesses. The case for plaintiff stated that the defendant continued to light log fires after being several times. warned, near Brown's boundary. The outbreak on February 21 was attributed to, these log fires. The defence urged that though log fires previous to the 20th might- have crept over to Brown's, and done inappreciable damage, the '..which buVned plaintiff's place on the 21st came from the kauri workings, through; the school reserve, on. to Kerr's, and thence to Brown's,'that '.defendant was in no way responsible for this lire, and was also a, victim of - it. Mr. Hayes appeared for V plaintiff, ■ and Mr. Coates for defendant. Both, counsel addressed the Court at length, and judgment'was reserved. -
