[by TELEGRAPH. —PRESS ASSOCIATION.] Wellington Thursday. The Appeal Court is enga&d with the Nelson case of Moore v. Oiford. The parties are medical practitioner, und appellant sold his practice at RMimond in 1905 to respondent, agreeing thattie would not practise within eight miles Richmond. In 1907 appellant went ify> partnership with two other medical petitioners in Nelson, which was within-eight miles of Richmond, and practiced Nelson ■ for three months Respondent- Orford, brought an action to recover liquated damages under appellant's bond, \nd Mr. Justice Cooper entered up judgment for £300.
