Sydney, November 3. In - the Australian Banking Company conspiracy cages, Judge Windeyer summed •up against the prisoners, Francis Abigail (the managing director) and Roderick McNamara (late manager).
The jury acquitted Messrs. Salem and Twist, the accountants of the Company, but found Abigail and McNamara guilty.
Abigail protested his innocence, and declared that he was not conscious that he had done anything to defraud any man. McNamara also declared his innocence.
His Honor, who apparently was much affected, said he had no doubt that the conclusion, arrived at by the jury was correct, and he regretted he could not think that Abigail's fraud was a momentary lapse, but that it was continued over a number of years, though he admitted that he had been the dupe of more wicked men. Abigail was sentenced to five years' and McNamara to seven years' hard labour.
Further charges against the accused have yet to be heard.
