RESISTING A DISTRESS WARRANT. At the Police Court yesterday forenoon, before Messrs. C. C. McMillan and H. Wilding, justices, a man named Otto Hen» drekß was charged with unlawfully assaulting John Filmer, a bailiff, while in the execution of his duty, by striking him on the head and arm with a stick, on the 11th inst. The facta of the case, as taken from the evidenoe, appear to be that the complainant, under the direction of Mr. S. Y. Collins, as owner of a dwelling in Wellington-street, occupied by Mrs. Sarah Turner, proceeded to the house at about half»past four o'clock to levy a distress warrant for arrears of rent owing by the tenant. lie read his authority to Mrs. Turner, and took possession of the house. About a couple of hours after he had entered, the accused came to the place and was immediately asked by Mrs. Turner to evict the bailiff. Hendreks promptly demanded by what right the officer had taken possession, and notwithstanding that the warrant was produced and read to him, he grasped the complainant by the collar and endeavoured to thrust him out. A scuffle ensued, in the course of which Hendreks picked up a heavy stick and struck Filmer repeatedly on the arm, and also gave him a severe blow in the face which cut his cheek. The son of Filmer was attracted by his father shouting for help, and ran off for Constable Bernard, who took Hendreks into custody on a charge of assault. These particulars were testified to by Mr. S. Y. Collins, John and Wm. Filmer, and Constable Bernard. Aocused had nothing to say in his defence save that he had some clothes in Mrs, Turner's house, and had gone there for them. The Bench considered that the prisoner had been guilty of an unprovoked assault, and sentenced him to one month in Mount Eden with hard labour.

The woman, Mr». Turner, who seems to have been the primary cause of the fracas, was arrested yesterday afternoon for assaulting Filmer, and will be charged this morning. ' __
