Whereas by section twenty-one of " Tbe Public Works Act, 1S70" therein referred to as " tbe said Act""), it is eoacted that whenever lands are required to be taken for public works th« Minister for Public WQrJfs, in the caso of Government works, shall cause a snrvey to4>e made and plans to be prepare f showing g-rjfrallr th« liatu-e o' the. works p ouosed to bo executed and the lands required to bo for tbe same, togethtr wrth the uames of he owners and occfnpieTs Qf such lands so far as*they can be a«certalfe'd, and shall rause a copy of »uch plans to be deposited in some placo in the road district in which supli land* are. And by section twenty-t «o of the sa{d Act it is further enacted that the »«id Minister sb'all cause a notice to be. gazetted, and to be twice publicly notified, statin? tli« place whero s»ich plans are open for inspection, with a general description of thtf* works proposed to be exerut d and of the land rt-cinired to be taken, and in such noti* e shall call . npon all persons afTrctcd to set forth in writing any welUfounded objections to the execution of such worhs or to the taking of such lands and to send such writing within forty day* from the flr.t publication of such notice to the eaid Minister. And b\ . sectiou twenty-five of »he "/.id Act it is enacted that, if within the said forty daysnosuch objecti. n s m v-e.orif afterdue consideration of such objection-the.-aid Minister is« f opinion that itlsexpadieutthat the proposed works should be executed, and that no private injury will bo done thereby for which due compensation is not provided by the said Act, the land proposud to be taken shall be taken in the fo lowing manner, that is to say : T be s*id Minister shall lay before the Governor a immortal containing an a curate description of tho land proposed to be taken together wbh a mapthereof, signed by the Purveyor-General or some certificated surveyor as evi ence of the accuracy thereof ; and the Governorln Council may thereupon, if he think tit, by Proclamation gazetted and publicly notified, declare that the said lands ure taken for tho use of a railway, or other public work, as tho ease may be ; and from and aft- r a dat>» t<> be na«ved in tho said Proclamation the land therein specified sbAll become absolutely vested in fee simple in ller Majesty, discharged from all mortiNiges, chtrges, claims, estates, or interests of what kiud .-oever, for the public use named in tbe said Proclamation : And whereas tho land described in tho Schedule hereto is required to b«. taken under th- said A t for a certain public work, to wir, the cons'ruction i f a lighthouse, lightJjecpt-r'a dwellings, with all rcquMto works, roads, and appurtenances, on Island Pokohinou, or Burpes* Island, Uuuraki Gulf, in tho Colony of New Zealand : And whereas tho aforesaid public work being a Government work, the Minister for Pub;ic Works bus laid before the Governor the memorial aod map mentioned in and signed and certified as required by the twenty-llfth section of ih-» said Act: Aud whereas all the requirements aud conditions prescribed by the said Act have been duly performed and fulfilled, and all thing* have happened and all times elapsed to lawfully authorize this Proclamation to be iss'ied : Now, therefore, I, George Augustus Con*tantine, Marquis of Noxmanby. Governor of tho Colony of New Zealand, by and with tbe advice and consent of the Executive Council of the said colony, in exercise and pursuance of the powers and authorities in me vested by the heroinb-fore in pnrt recited Act, and of any other power and authority 6nab'ing mo in th t behalf, do hereby proclaim and declare tint ih*> land described in the Schedule hereto Is hereby ta'-ten for tho purpose as aforesaid; and that, from and after tho twentieth day of February. 1579, tbe land so described shall bee me absolu ely vested in fee simple In Her Majesty, discharged from all mortgages, charges, claims, estates, and interests of what kind soever, lor use as aforesaid. SCHEDULE. All thatplccs or parcel of land situate on Pokohinou, or Burgos Island, in the Har.raki Gulf. Colony of New Zealand, containing by admeasurement twentj-four (24) acres aud ttirty-fivo (35) perches more or less. Commencing at a point on the line of high-water mark, B«id point be-iring due Kast from th- lighthouse rite, and at a distance from it of eighty (SO) links or thereabouts; thenco in a g nerally northerly direction along said line of h yh-water mark for a distance of seven hundred (700) links or th ; tbeace by a line in a north-wo«terly direction, on a bearing of 14-i* 17', f r a distance of six hundred and fifty-nino (C. r >9) links or thereabouts, to a point on the line of mark on the north-western boundary or coast line; thence following along tho line of said hi h>water mark for a distance of fifteen hundred (1500* liuks or thereabouts ; thence in a southerly direction, on a bearing of 10* 3i', for e distance of one thou and live hundred aud oeventy (1570) links or thereabouts, to a point on t> e line of hi/h-water mark oa the southern b ttndary or coast line ; thence in a generally easterly, southerly, and northerly direction along the stiid lino of high-water mark, for a diatanc- of two thousand eight hundred (2SOD) links or thereabout*. to commencing point; acc. ss to the east and we-t portion of island being given by a road onu chain wide; all in the manner delineated on the map marked M.D. 101, attached to tho memorial referred to. Given under the hanl of His Excelloncy tho Most Honorable Geo'ge Augustus Constantino, Marquis of Normauby, Earl of Mulgrave, Viscount Normanby, and BaTon Mulgrave, of Mulgrave. all in the County of York, In the Peerage of the United King om; and Karon Mulcrave of £«ew ltpss, in the County of Wexford, in the Peerage of Ireland ; a Member of Her Majesty's Moat Honourable Privy Council; Knipht Grand Cross of the Most Distinguished Order of -alnt Michael and Saint George; Governor and Commanderin and over Her Majesty's Colony of New Zealand aod its Dependencies, and Vice-Admlral of the same-; and i-sued under the Seal of ihe said Colony, at the Government House at Wellington, this fifteenth day of February, in the year of our Lord one thousand eight huudred and seventy-nine.
