The City Council and tho various local borough councils recently decidod lo \mpose an additional 10 per confc on all rates over six months nob paid by a certain date in December. It now appears that this additional charge is illegal. Messrs Dovoro and Coopor, solicitors, wrote to tho Devonporb Borough Council : "Wo have considered the question submitted by tho Mayor whother rates which re main unpaid after six months from tho date on which tho same first becamo recoverable boar i he additional charge of JO per cent specified in section GO of tho Hating Act. Tho quostion applies fco rates already made. As to rates to be made thoro is no doubt a liability attaches. Tho Act provides that any rates made prior to the commencement of tho Hating Act of 1894, which camo into operation on tho 9th Octobor, may, if necessary, bo sued for and rccovored under the ropealed Act as if tho Aob of 1894 had not boen passed. In our opinion tho 10 per cont does not; apply to rates already made and in arroar. Tho solicitor's opinion was recoived and ordered to bo published,
