SEVERE COMMTNTS BY A JUDGE. njmiED Press Ao^oclvtios.] . PALMERSTON N.. Thursday. At the Supreme Court to-day, before Mr .Justice Cooper, nue Donald sued C. Fitzgerald to recover £500 alleged to have been obtained by misrepresentation, also for dissolution of partnership agreement. Mr Gifiord Moore, who appeared for the plaintiff, said defendant had en- . ticed his client to put £500 into a saw- f mill at Tokomaru by misrepresentation. : A quantity of evidence was taken. ! His Honor gave judgment for the plaintiff for the £527 obtained by d->- ! fendant from plaintiff, and declared the partnership agreement void, on the ground of fraud. He also ordered the ' defendant to pay interest on the amount at 8 per cent from the time the money was paid over to date. Costs wore also ; allowed on the highest scale. ! Mr Justice Cooper said either one side or the other had committed deliberate perjury, and he ordered all the exhibits to be impounded.
