Powers Of Deportation

SYDNEY, Sat. (Noon).—The Federal Government will appeal to the High Court against the decision by Judge Curlewis in Sydney yesterday preventing the deportation of a Malay seaman, Abdul Samat Bin Amjah. Amjah successfully appealed in the Quarter Sessions Appeals Court against a deportation order. Amjah married an Australian girl in 1943 and has three enuaren of the marriage. He said he would continue to fight against the Commonwealth efforts to deport him. Senior Federal Ministers said in Canberra that Judge Curlewis’ decision was so important that the Commonwealth would have to test again in the High Court its powers to deport Asiatics. Judge Curlewis’ judgment could upset the Government’s plans to deport the remaining Asiatic wartime refugees under deportation laws passed during the last session of Parliament.
