Home Guard Power To Dig Road Trenches
lias the Home Guard power to dig trenches along the road. and. if it has the power, is a county council responsible for any damage caused through the trenches oeing on a roadway.
These questions were asked by the Feathcrston County Council of the Counties’ Association, which, as all county councils were interested, forwarded the telegraphic reply of its solicitor in a circular letter received at the monthly meeting of the Whangarei County Council today.
"Home Guard has no power to d,g trenches along road unless as part of defence forces it does so under orders from the Minister in pursuance of Defence Emergency Regulations. Safeguarding Councils “Council not liable for accident if work done under such orders but might be held liable in case of unauthorised work if it took no steps to remedy dangerous state of road.”
The association stated that to safeguard their councils, county clerks were advised to:—(1) Make careful investigations into any order or authority submitted by the Home Guard. A proper order should be signed by a responsible military officer. (2) Erect a protective fence around any trench dug on a road, if such trench had been dug without military authority. (3) Stop any trench digging on roads without proper authority. The letter was received without discussion.
