CLAIM FOLLOWS COLLISION AT SEA
(Received 11 a.m.)
MELBOURNE, This Day,
The hearing of the Union Steam Ship Company’s claim for £50,000 in connection with the collision between the Kakariki and the Caradale in Port Philip oh January 29, has begun in the High Court. Defendants, the owners of the ship Caradale' and her freight and cargo, have a counterclaim for £25,000.
The collision resulted in the sinking of the Kakariki, with the loss of five lives. Plaintiff claims th'at the Kakariki was navigated- properly in regard to safety, and that the Caradale neglected to keep a proper look out and failed to give warning of ifer change of course, and that she failed to stop or'reverse when a collision must have been apparent. Defendants deny that the collision was caused by contributory negligence or by improper navigation of the Caradale. They say the collision was caused solely by the negligent navigation of the Kakariki, which, having become the crossing vessel, failed to keep out of the way of the Caradale.
