At. the Hastings Magistrate Court the other, day, before Air A. M. Mowlem, S.M., a case was heard la which Miki Thomas sued W, A. Smith, of Gisborne, for £250. The claim was for the recovery of the racehorse Pllnimerton, which it was alleged had been wrongfully sold, or in lion thereof, £2OO and £SO damages. For the plaintiff it was contended that H. S. Greene, horse trainer, had sold 'the horse to defendant without any authority to do so. Plaintiff stated that the horse was raced in his name at Wairoa, and from there it went on to Gisborne, where it was successful in winning. Plaintiff w;as not present at this meeting, but he learned later that the horse had run. in the name of W, A. Smith. Plaintiff then demanded Hie return: of the horse and also the stake money, but this was refused. For the defence it was held that plaintiff had given Greene authority to sell Plimmenton as well as other horses. Accordingly, the sale had been made. Lengthy evidence was given and after hearing this his Worship decided that the sale was in order and non-suited plaintiff, allowing £2l 11s costs to defendant.
