CLAIM FOR RETURN OF JEWELLERY AND SHARES FAILS United Ps ess Association—Bv iriectrlc Telegraph.—Copyright. Received Wednesday, 10.25 p.m. SUVA, April 13. In the Supreme Court Colin Woollam Anderson, company director, of Auckland, claimed from Gladys Neville Windrum, a married woman of Suva, living apart from her husband, the return of jewellery of an estimated value of £5500. Anderson said he handed defendant on December 6, 1936, 620 one pound shares in New Zealand Newspapers, Ltd., and a life insurance policy for £IOOO payable in 1940. He claimed that be became acquainted with the defendant in Auckland in April, 1934, and in December promised her an allowance of £3OO yearly and for the purpose of securing that amount, the jewellery, shares and policy were handed to defendant as security. The defendant claimed that the articles were a free gilt or alternatively were given in respect of unlawful, illegal and immoral association during tohich plaintiff cohabited and committed adultery. The articles were, a gift made in furtherance of the said association.
In a reserved judgment the Court said it was satisfied that the delivery of the jewellery and the transfer of the policy were not a gift but were made as security. The Court held that the shares were transferred as a gift. Considering the alternative defence, however, it found on the authorities quoted that plaintiff could have no relief from the Court. No order was made regarding costs.
