Feilding Horse Trainer's Claim

GRAND JURY’S WINNINGS The Pending Magistrate’s Court was yesterday asked to settle accounts between W. A. Jorgenson, horse trainer, of Feilding, and D. Lourie, farmer, of Turakina, concerning the training ,of the racehorse Grand Jury. Mr R. M. Watson, S.M., was on the Bench and gave judgment for plaintiff Jorgenson for £63 3s 3d with costs £6 17s. Jorgenson claimed from Lourie the sum of £B3 13s 3d, being balance of training fees and expenses on account of the racehorse Grand Jury, as woll as a percentage of winnings due, as agreed upon. Training fees due were set down as £63 3s 3d and balance of percentage due on stakes as £l9 10s. * Plaintiff gave evidence as to the arrangements entered into with defendant for the training of Grand Jury at a fee of £3 per week, with 10 per cent, of winning stakes. Accounts were rendered to defendant, ■who paid up from time to time, when when the final settlement was arrived at a dispute occurred as to the amount due to plaintiff. During the time plaintiff was training Grand Jury the horse annexed winning stakes to the value of £1035, which included cups to the value of £,150. Plaintiff only charged the percentage of the specie, not on the cups. Supporting evidence was called as to the training of the horse and the rendering of accounts.

Defendant in evidence admitted the arrangements as to the training of Grand Jury, but denied that there existed any understanding that he was to be liable to plaintiff for 10 per cent, of the winning stakes. He admitted having made gifts to plaintiff on occasions when the horse won, but these were not by -way of an admission of his liability to pay Jorgenson a percentage of the stakes. After hearing the evidence the Magistrate gave judgment as recorded above.

At the hearing Mr Rolling appeared for Jorgenson and Mr Stanford for defendant.
