Peer as a Witness
TOLD TO LEAVE BENCH A magistrate peer who gave evidence in an English court recently in which he was sitting was told to leave the bench. He was Lord Sandys, one of the Worcester County magistrates, who gave evidence in an ejectment application against a former worker in his estate. After giving eveidence, Lord Sandys* who, it was stated, was not adjudicating in the case, walked as though lie intended to take his seat on the beneu, when one of the magistrates. Mr. T. W. Parkes, exclaimed: “I am going to object to Lord Sandys coming on the bench after giving eveidenee in the Witness box. It is perfectly wrong procedure altogether.”. ... The chairman, Mr. H. C; Gardnerthen remarked to Lord Sandys, “I am afaid you must retire.” On the ground that the notice to quit was not valid, the application against the tenant was dismissed.
