JUDEMENT FOR PLAINTIFF IN COW SHOOTING ACTION

£l6 DAMAGES AWARDED. Mr. J. L. Stout S.M., gave judgment yesterday in tho case in which A. B. Terry sued Arthur Needham for £2O damages, the claim being that on October 5, 1928, defendant trespassed upon the property of plaintiff and thora wantonly and maliciously destroyed a cow,'the property of plaintiff. Tho judgment read: “In this case, I have come to the conclusion that there was no danger to the children such as would excuso the shooting by defendant of plaintiff’s cow. ” “The defendant seems to have lost his head. There was no evidence that the cow was vicious. On tho contrary, the evidence goes to show that it was quiot. Defendant could have climbed the fence and chased tho cow away. 1 fix tho damage at £ls.’’ Judgment was accordingly entered for the amount fixed, with £-i 11s costs and £1 12s witness’ expenses.
