APPEAL UPHELD.
LADY TROTTING OWNER. Per Press Association. DUNEDIN, June 13. The decision of the appeal judges appointed by the Trotting Conference to hear the appeal of Mrs M. Clark, of Winton, owner of the trotter Stirling Lady, against the decision of the New Zealand Trotting Association in dismissing her appeal from the decision of the Wyndham Trotting Club, is now announced. The judges, Messrs B. S. Irwin, A. C. Hanlon, and J. S. Sinclair, have upheld the appeal, ordered the return of the deposits made by appellant for the appeal and referred the question of costs to the Trotting Conference. Their conclusion is that the proceedings, which purported to be an inquiry by the stewards of the club,, were consequent upon an objection being made by the stipendiary steward. Apart from this conclusion, the judges state that appellant could succeed on other grounds. The facts are that in the concluding race at the "Wyndham meeting Stirling Lady heat Pot Luck, but the judge’s placings were reversed by the judicial committee on the ground that Stirling Lady bored in in the final stages. The club’s decision was upheld by the Trotting Association, whereupon the present proceedings were taken.
