FALL FROM TRAMCAR
DAMAGES CLAIM SUCCEEDS

A passenger who fell from a tramcar bound for Avondale in May last made a claim in the Supreme Court against the Auckland Transport Board for damages for injuries lie received as a result of his fall. Plaintiff, Harold Thomas Middleton, a market gardener, of Avondale, claimed that the accident was due to negligent driving of the tramcar, as a result of which he was thrown off his balance as he stood on tho platform. Plaintiff had suffered a serious compound fracture of the skull and he would be permanently unfitted for his work. General damages of £ISOO and special damages of £lB4 were claimed. The board denied there had been any negligence on its part, and alleged that, while under the influence of liquor, plaintiff cither fell from the platform or attempted to leave while the tramcar was in motion.
The jury brought in a verdict, by a majority of nine to three, that there had been negligence on the part _of defendant board and awarded £SOO general and £lB4 special damages.
