CLAIM FOR INSURANCE.

Per Press Association. WELLINGTON, Nov. 23. That the price of the car concerned in the :dispute had been inflated and that it had been over-insured by the fraudulent device of the plaintiff company, acting through its managingdirector and its Napier agent, was the conclusion reached by Mr Justice MacGregor in his reserved judgment in the case which the Tourist Motor Company, Ltd., Hastings, claimed £llOO against an insurance company in a policy over a nine-seater car sold by plaintiff to Leonard Ralston Wyllie in February, 1931, on behalf of his brother, under a hire purchase agreement for £ISOO. His Honour said he was satisfied that the cash value of the car when sold was not £ISOO, but to the knowledge of Hislop it was not more than £1250. The car was used as a service car but the run was not a success and promissory notes held by plaintiff fell into arrears and the car was taken back to plaintiff’s garage at Hastings, where it was destroyed by fire in October last year.
