CLAIM FAILS.

NAPIER, Sept. 9. In a written judgment given to-day, Mr Justice Ostler found in favour of the South British Insurance Company in a claim against it for £3OO under a policy on furniture destroyed by fire, brought by George Alexander Wilson, the owner of both the house and the furniture.
His Honour considered that plaintiff’s story was unbelievable and said he was exceedingly fortunate in not undergoing imprisonment for the crime of arson. Plaintiff was twice tried on a charge of arson and the jury each time disagreed. When the brigade was called to the fire, which occurred last October, there was a strong smell of benzine. The house had been vacated by tenants on the morning of the night of the fire, and plaintiff was at the premises an hour or two before the outbreak.
