MARLBOROUGH LAND BOARD.

Tho Board met at Blenheim on Tuesday. Pre-sent—-Messrs Olarke, Chief Commissioner (in the chair), Dive, Paul, Robinson, and Hodson.

The minutes of the previous meeting were read and confirmed.

The Chief "Surveyor reported that instructions had been issued for the immediate survey of the lands included in the following applications : —No. 4, 50 acres ; No. 10, 100 acres ; No. 11, 50 acres. The above applications are situated in the Pelorii3 Sound and within the boundaries of the district proclaimed as being set apart to he dealt with under the deferred payment system. Messrs C. Y. Fell’s and W. Syms’ applications, which were beforo the Board at the previous meeting, were again brought forward. Mr Fell on this occasion applied for a license for mining purposes instead of a lease. To these applications objections were lodged by E. W. Clements and W. Eason. Mr Robinson suggested that the opinion of the Crown Land officers should be taken ns to powers of dealing with tho foreshoro, and referring them to the “Harbours Act, 1878." and moved to that effect. A lottcr had been received from Under-

grant a license termhmhlo at will, but it did not appear that the law officer’s opinion had been taken.

Mr Robinson’s motion was seconded by Mr Dive, put, and carried. Mr Sinclair applied for Mr Byrne’s application for mineral lease to stand over until next meeting. His client had instructed him to apply to a Board of Enquiry and special survey, but he (Mr Sinclair) thought it would be better for the matter to stand over, so as to get it before the Supreme Court. Mr Byrne wrote to the Board applying for compensation for expenses incurred by coming to Blenheim to attend a meeting of the Board, which did not take place. Mr Byrne asked tho Board to pay him £lO, and to inform him when the Board would meet.

To this the Chief Commissioner replied that the Board would meet on the 6th in-tant,

In reply to Mr Hodaon the Chairman said there were no funds available with which to meet Mr Byrne’s claim. The Board declinod to entertain the application.

In the matter of an appeal against the decision of the Board in reference to the mining lease granted to Messrs Kell and Horton, and objected to by Mr Byrne, Mr Sinclair statod a case for the Board to decide upon to go to the Supreme Court.

On the motion of Mr Hodson it was agreed to refer tho matter to the Crown Solicitor to agree to a case and defend on behalf of the Board.

Mr Sinclair said he would retain his friend Mr Rogers.

A license to Mr Byrne to mine for coal at Black Point, Pelorus, was granted. An application for a transfer of a pastoral lease of May Bank Run from .Mr A. Duncan to Mr John Duncan was granted. Mr Jos. Rutland. Ranger, reported as follows : —“ Pelorus Valley, November 9th 1880. The second year of Mr Chus. Smith’s tenure of section No. IGS, Kenepuru Sound, under the deferred payment regulations expires on the 6th November. I have the honor to report that he has fulfilled the requirements of the 1 Act, having cleared, grassed, and otherwise cropped more than one-tenth of the land. Mr Smith regularly resided on the ground until about six weeks ago, when, being short of funds, he took some work in another part of the Sound, but intends to return to his holding in a week or two.”

The Under-Secretary notified that the Governor approved of the upset price of £960 for section 1, block 11, Clova Bay, at present open for sale on deferred payment. An application by Kopama Timote and another Maori for the Te liuakaka Reserve was read, and the Board agreed to put up the license for the land to auction.

Mr Adams, of Langley Dale, applied to the Board to have surveyed and put up for sale 548 acres at Qnamnlutu.

The Board decided that it was not desirable to sell the land as it was supposed to be auriferous.

A timber license in favor of Mr J. B. Dick, Pelorus, was approved for signature. The Board then adjourned.—Times.
