LOUD DENIM'S EVICTION
GOVERNMENT HOUSE APPEAL
JUDGMENT OF THE HIGH
COURT
THE EVICTION CONFIRMED,
[Pbess Association.]
SYDNEY, June 19. The High Court delivered judgment in the appeal against tho State Court's decision in connection with' the alleged eviction of the Governor-General from Government House.
The Court unanimously allowed the appeal, thus confirming Lord Dennian's eviction. Mr Justice Barton, in delivering judgment, said that when New South Wales in 1855 received her Constitution, and with it full control of the waste land, it would be marvellous indeed if she were refused control of Government House land. Clearly it was part of the lands taken over by the self-governing community, and if it were assumed that the original nature of the Governor's office meant Imperial control of land the transition to Constitutional Government by parity of reason meant colonial control.
The Labor party is jubilant at the Court's decision. Mr Carmichael proposes, provided there is no appeal to the Privy Council, to proceed at once with the scheme for utilising Government House and grounds for the public benefit, imcludiing the erection of the Conservatovium of Music.
