In the case of Lee v. Jones, heard at the Christchurch Supreme Court yesterday, the plaintiff, Alfred Lce.f sued the defendant, George T. Jones, for £750 for alleged negligence in hanging up a b.nce and bit in a particular place, whereby plaintiff l"st his right eye. It was alleged thnt plaintiff, at the request of defendant, iis»ii.Ud him tocutclmff,and that defendant, having used a brace and bit to repair the belting of the chaffcutter, negligently hung up lhe brace and bit, under which plaintiff in the course of , his duty passed, the point of the tool piercing his right eye as he did so. The statement of defence was a- general denial of all the material issues or that plaintiff had any right or occasion to pass under the place where the tool hung, and claimed that the brace and bit were placed where defendant alone had a right lo go ; that plaintiff was not employed by defendant, but was there of his own motion and that he saw defendant hai'g up the brace.
