During last week the Waimumu dredge returned 250z. and Cbarlton Creek 12oz. Since the Hartley and Riley's phenomenal .return of 1187oz. shares in that company have advanced in value, and are now quoted at £23 17s 6d, with an upward tendency. At Invercargill last week, Major Keddell S.M., gave judgment in the case G. Dempster, Edendale (for whom Mr Inder appeared) v. the Southland County Council (Mr Macalister), a suit to recover £7 17s (id. The plaintiff purchased certain privileges from the Wyndham Racing Club and applied to the Council for a conditional license to sell liquor on the racecourse, which was issued, a certificate having been obtained from a magistrate. Thn Wyndham Town Boaid then demanded from him the fee, alleging that they were the proper persons to receive the same. Dempster refused to recognise the Town Board, and acted upon the license granted by the County Council. The Town Board prosecuted him for selling without a license, and he was convicted and ordered to pay tho license fee to the Town Board. The grounds upon which tho Board proceeded wore that the racecourse was within their jurisdiction, and not within the County. Dempster sued the County for the money paid to them by him; lor the tine and for all his expenses, in all £7 17s 9d. Sevei'iil law points were raised, the principal for the defence being that money paid under a mistiik'! of law could not be recovered, and that the County could not be held responsible for plaintiff's acts. The plaintiff relied upon a case decided by the Supreme Court, but it was pointed out Mint-there wns a distinction which arose from certain fsic'a. The plaintiff was nonsuited with 21s costs, his Worship holding that he could not .n-.cnvci. Mr Charles E.
