THE VERDICT.
In announcing his decision Mr Revell said:' This is an information against lan Simßon SimSOn for the "embezzlement of a cheque for L 35 1155. -Od going through the evidenoe and carefully considering it I have come to the conclusion that that of Mr Els worth, goes to' show that on the Bth August Mr Simson rooeived : the , cheque for which he did not account to biS firm or to the bank at. Gore, and he , .maintained secrecy about the cheque nntil 12th August -in Dunedin when he cashed it, getting One cheque for LIOO and.etnother for 'the balance. On his return; to. Gore on the 16lh he appears to have paid out certain sums of money to ,' creditors of the.'firm. He could hot get , access to his books and the partnership , bad been • dissolved. He had told his partner that he had received the cheque \ apd that he intended to and was paying certain accounts out) of it— this before the information was laid for embezzlt- ' nieht; I think, on tho whole, the cvi- ' dence shows that Simson is free from the 1 charge and that he has noi been guilty of , embezzlement. He may have acted irijttdicibusly, but that would hot warrant me in sending him to a higher Court for trial.. Apparently most of the money was. paid to. creditors of the firm. — In- , formation dismissed. #- The result was received by the crowd who had collected .at the Courthouse with manifest expressions of satistaction.
