MAGISTRATE'S COURT.

CHRISTCHURCH,

Mr H. W. Bishop, S.M., presided at the Magistrate's Court yesterday. Stephen Carr, Frederick Jackson and William Musson were remanded till Wednesday charged with the theft at Halswell of twelve sacks of potatoes and four sacks of chaff, valued at £9 14s, the property of the New Zealand Express Company. I>aniel Everett, a youth, just over sixteen, was remanded till the following day charged with attempted breaking and entering on the premises of Richard Nash and John Graham in Manchester Street with intent to commit a crime. A juvenile, aged fifteen, was remanded on the same charge.

Judgment for the plaintiffs hy default with costs was given in the following cases:—R. T. Cowper v. C. Hale, £9 Os Gd; James Knight v. James Keene, £2 6s lOd; Costefio and Derryman v. S. Wilson, £3 10s; L. W. Balkind v. J. R. Wrddroll. £2 10s 6d; H. E. Sexton v. Margaret L. Rowe, £1 0s 6d; International Harvester Company v. M. J. Driseoll, £l7 19s LOd.

In the case of Fred Billingham, trading as Browne and Heaton (Mr Thomas), v. W. Marwick (Mr M. Donnelly), claim £5 5s 9d. in which an adjournment had been eranted with costs to the defendant to allow the plaintiff to make certain affidavits, Mr Donnelly further submitted that_ the action was improperly brought, inasmuch as the names of the parties were not entered in the plaint noto, and the affidavit did not get over tho omission. Mr Thomas said that Mr Donuelp had accepted his guinea, on the first adjournment, and it was & scandalous thing to raise another oejection on the second hearing. "I went as fai as was necessary," said Mr Donnelly. Mr Thomas said that Mr Donnelly. having accepted ths rruinea for the adjournment, had implied that he was prepared to let the ca&e go on. " I am amaaed to hear any solicitor of the Supreme Court say such a thing," replied Mr Donnelly. "I raised tho objection last time that the plaint was improper. Billingham said that he was manager. Now he sayt that ho is principal, and no-w Mr Thomas says the debts aro handed over to him." The Magistrate remarked that Mr Thomas seemed to think that Mr Donnelly was seeking cost 9 again He did not think that himself. "I am too well known a practitioner," said Mr Donnelly, " for anybody to think that I am a costs huntor. If it is any good to Mr Thomas, he can have the guinea back again." "I would be very glad to seo it," said M> Thomas. "No doubt you would," laughed Mr Donnelly. The Magistrate said that he would noiisuit plaintiff.' without co&ts. " Then we will keep the guinea," said Mr-Donnelly. "It has been well earned." LYTTELTON. Captain, R. Hatchwell, J.P., and Mr F. W. Anderson, J.P., presided at tht Lyttelton Magistrate's Court yesterday. J loyd Arthur Townsend was charged with having on board the jtraw;: at Wellington, on September 12, assaulted a male with mdeoent intent. Mr A. T. Donnelly appeared for the defendant. After evidence had beei given, the information was dismissed. AKAROA. Mr T. A. B. Bailey, S.M., presided at the Akaroa Magistrate's Court on vVednesday. G. Reynish (Mr Williams) was charged by the Pigeon Bay Road Board with allowing cattle to graze on the public roads. Defendant was convicted and ordered to pay costs. On two breaches cf prohibition order E. Smart was fined 20s on each charge. In Toko v. W. Glynan (Mr Williams) claim £l6 10s for balance of rent, judgment was given for plaintiff for £5 2s and costs. In judgment summons cases, Bassott and Co. (Mr Williams) v. W. Hunter, for £4l 12s 7d, and Maling and Co. v. H. F. Lelievre (Mr Williams) for £ls 19s,' both cases were adjourned till October 4. . ASHBURTON. Mr G. W. Andrew's, J.P., presidec' at the Ashburton Magistrate's Cour' yesterday. Cornelius Patrick Sullivan was charged with assault with intent to commit a criminal offence. Accused wa* remanded until September 20.
