THE SYDENHAM SEWAGE SCHEME.
' TO THE EDITOR. Sir, —So it seems that .the Drainage Board and Christchurch. City Council, being badly beaten at law, the ' former body has decided to cut tho connection between the depot and the sewer. It would be well if the Board considered its position before acting in this arbitrary manner. Upon the faith of the permit granted to the Sydenham Borough Council on Dec. 13, 1893, and the subsequent acquiescence of the Drainage Board till the present time, the Council incurred considerable expense in erecting the depot and establishing the scheme. Now, it is a maxim in law that if any person or body, acting upon the faith of an express written (not parole) license or authority, incurs expense, then the body granting such license can only revoke it upon terms of compensating the licensee for the consequent loss and expense. This permit would support a plea of equitable acquiescence and an injunction might be obtained staying the cutting off of the connection. —I am, &0., *MICHAEL HART,
