Au Eevoir was scratched for all engagements at the Wellington Summer Meeting at 10.45 this morning. THE TRESPASS CASE, DUNEDIN, Jan. 4. At tho police court Mr Carew gave judgment in tho test cases brought by the Dunedin Jockey Club against disqualified bookmakers, charging them with trespass. Mr Carew found both guilty, and inflicted fines of 50a each, with costs, making the total in Brown’s case of £4, and in Jones’ case £5 160. He declined an application not to record judgment in order to permit of an appeal to tho Supremo Court. In giving judgment in tho trespass case brought' by the Dunedin Jockey Club against disqualified cash fielders, Mr Carew said:—“lt is contended that the defendant was on the racecourse by license of the Jockey Club, and that whether that license was properly determined raises a question of title that ousts the jurisdiction of the court. In the first place, there is a doubt in my mind whether the defendant did procure a ticket. It teems strange that he should have bought ono, having bo intention of using it for its proper purpose to get admission at a gate. Then, when ordered to leave the course, he made no claim that he had a ticket, and he produced no ticket here to verify his statement. I feel a strong doubt on the question, but I will not go so far as to cay that defendant and his witness have sworn falsely. Assuming then that the defendant had a ticket;, docs the evidence show that he went on the land and refused to leave it in tho bond fide exorcise of a claim of right to be there ? Mo knew that he was disqualified, and had boon turned off the course before, and that a ticket would not procure him admission. A. licence moans” permission, and if obtained by misrepresentation and deceit, or by mistake without fraud, ib is a nullity—(Addison on Torts, oixfch edition), la this case the defendant’s evidence shows that; ho knew ho had not the club’s permicaion to go on the course, and that he went there aud remained there against their will. In the face of this, I cannot see any land, fide question of title. Convicted, and fined 60a, costs of the Court 15s, five witnesses 30a, professional costa 21a; total, £5 10s. His Worship added that it was optional in a case of this kind to inflict a sentence of imprisonment iaato’id of a fine, the term not to exceed three ytaontbe. However, ho simply inflicted a fine.
