The Justioe, before reading his judgment, explain that it was his own, and that Mr Juetice Gillies agreed with the other judgment, which would be read by Mr Justice Williams. Upon some points, the opinion of the Chief Justice was in favour of the Appellant, but the CW held that the Southland Waste Lands Ac” Amendment Act of 1873 was intended to appU to the Waste Lands of the Crown, although in the occupation of holders of pasturage licenses and (dissentient, Prendergast, C.J.) that the power of the Superintendent to set aside lands for sale on deferred payments had been duly exercised with regard to the lands in question. The four questions proposed by the case are therefore answered in the affirmative. Mr Justice Johnston also read a written judgment in concurrence with that of Mr Justice Williams. A motion on behalf of appellant fot leave to appeal to the Privy Council was refused on the ground that the Queen’s Order in Council gives no power to do so. He will petition the Governor in Council for leave to appeal to the Privy Council. The judgments were very long.
