LYTTELTON BOROUGH COUNCIL.

Monday, Not. 29. The Council held its usual meeting. Present —Councillors Chalmers, Buist, W. Graham, Allwright, F. Graham, Cunningham, Parsons, Hawkins ; his Worship the Mayor presiding. RECEIPTS AND EXPENDITURE. Receipts, £7 18s; expenditure, £4O 19s 9d. WINCHESTER STEEBT GULLY. The Mayor said Mr Thornton had been in during the week, and with the Foreman of works, bad inspected the spot and expressed his willingness to fall in with the Council’s views. The diverson of the sewer he said ought to be carried out. He (the Mayor) had written to Mr Thornton asking bis advice in the matter, and he hoped before the next meeting to have fuller information. ME CALO’S HOUSE. With respect to this property the repairs were going on. TENDERS YOB WEIGHBRIDGE OFFICE. Two tenders for this building were opened. G. M. Warne, £lB 10s; J. Leslie, £ls. Councillor Allwright moved, and Councillor Hawkins seconded— ’’ That the tender of Mr Warne be accepted.” Councillor Buist protested against tho building being sold. It had cost now nearly £l2 removing, and by expending a further earn they would get £2O per annam; it could be put near to whore Mr Jenkin’s shed was. Councillor Chalmers moved an amendment —” That the Foreman’s instructions be carried out.” Councillor W. Graham seconded the amendment. The Foreman said it would cost £ls to put the building in repair. Councillor Allwright contended that if the Council did place the building where named, it would have to be covered with iron. He thought the Council had done wrong in letting Mr -Jenkins erect his building without it so being covered. Councillor Hawkins coincided in the former speaker’s remarks, and thought the Council had committed a breach of faith with the ratepayers. The amendment was put and lost, and the motion carried with three dissentients.

DBAINAGE. His Worship said that several persons in Loudon street had taken action in the matter of laying down pipes to the main drain. BEIDLB FATH SURVEY. The Mayor said he bad received from Mr Farr a map showing tho survey of the Bridle Path, made and signed by Mr 0. Davie, Chief Surveyor. Dr Donald had told him this was mode when he was Chairman of the Municipality. It appeared that there was some dispute on some property on the Bridle Path. Mr Farr was asked to make some surveys. He, not wishing to take the responsibility, got Mr Davie to make this map. This showed things in a very different light; they had been told that the Bridle Path above Ticehurst road was only a track, but the map showed differently, and proved that Captain M'Lellan’s property encroached upon the Bridle Path, and that Steinson’s line was the correct one. It was very satisfactory for the Council to have such a map signed as it was by the Chief Surveyor. He thought the Council did not wish to deal harshly with Captain M’Lellan, and perhaps as it was shown that a considerable portion of the property belonged to the town, they might call upon him to pay a nominal rent. Councillor Allwright said the Council could not let anyone have tho property. It was on a public path. The Mayor said they had been threatened with legal proceedings from Captain M’Lellan for encroaching on ground which appeared by the map did not belong to him. Councillor Chalmers said that there was an encroachment on Ticehurst road, bat the Council had no power to interfere. They could uot blame Captain M’Lellan in the matter of encroachment, for he purchased the property, still the public's right must be enforced, and the least that could be done by the owner was to give up the corner section of the land, and build up a retaining wall. He thought a resolution had been passed some time since that the land shonld be properly pegged out, and he would move—” That a Surveyor be employed to mark off tte&pidle path,as shown by Mr o.Davie’|map. Councillor Hawkins said that Tie had been informed that the original map could not be found in the, Government Map Office. The Council ought to be careful to enforce their rights. He would second the motion. : The Mayor said that Dr Donald distinctly recollected the map when it was shown to him.

Councillor Buitt said that what war wanted was that coiner leading up to Tioehurst road. Councillor Allwright said that, according to the Southern portion of Sir Davie’s map, the line given by Mr 0. Cuff to Mr Steinson was correct. The motion, with the addition of Mr C. Guff’s name as Surveyor, and also an instruction regarding inquiries respecting Mr Dudley’s land was then put and carried. DEPUTY COEONKB. In reply to Councillor W. Graham, the Mayor stated, that no reply had bean received to their letter in this matter. DiaHiiwa. Councillor Allwright asked if the Lighting Committee had considered the feasibility or lighting the town with gas. He considered, if it could be done, it would be a great boon to the inhabitants. Councillor Buist said the Council could not bear the expense. The Mayor considered., if the Committee could see their way clear in the matter to light the streets with gas, a small lighting rate would be cheerfully paid. Councillor Cunningham said the erection of thirty-four lamp-posts would cost at least £250. A discussion ensued on the matter, in which it was suggested that lamp posts only in the Town need be erected at present, as the gas main did not extend beyond it. The matter was left to the Lighting Committee to bring np a report. The Council then adjourned.
