MANAIA R.M. COURT.
(Before Major Take, R.M.) ALLEGED CRUELTY. TO HORSE.
William Burke was charged, on the information of Police Constable Salmon, with cruelty to animals. The alleged offence consisted in having knowingly allowed a horße with a broken leg to remain in an uncared for condition for a considerable length of time.
Accused pleaded not guilty. H. W. Ellerm said that he knew the accused; he saw him in possession ot a horse, the subject of this case, last Monday week. On the following Saturday his attention was directed to the same horse ; ita leg was very badly broken, the skin being torn, the flesh exposed, and pieces of the bone protruding. Pieces of the bone were also lying about where the horse was grazing. Those pieoes of bone now produced were picked up by witness, and had evidently come out of the horse's leg. The horse had, be heard, been in tbat state from the Tuesday to the Sunday following. Constable Salmon gave evidence as to baying seen the horse, and laid the information. The horse was on the Sunday in the condition described by last witness. Witness shot the horse.
The police said fnrther evidenoe could be procured. Farther hearing adjourned till next court day.
