COUNSEL AT VARIANCE
PASSACE IN NAPIEB COURT MR LUSK AND MR ROGERS A verbal encounter between the Crown Prosecutor, Mr H. B. Lusk, and counsel for the defence, Mr L. A. Rogers, (luring the hearing of the sheep-stealing re-trial in the Napier Supreme Court yesterday afternoon, resulted in his Honour, Mr Justice Reed, threatening to deal with Mr Rogers if he continued his method* of procedure. The Crown Prosecutor "as examining a Cronn witness when Mr Rogers made several interruptions. Crown Prosecutor: If you are going to he offensive, there will be trouble. Mr Rogers: I probably will be. Hi s Honour: If that is so, Mr Rogers, I shall have to deal with you. Mr Rogers: I beg your pardon, Your Honour ? His Honour: I understand you to sav that you probably "ill be offensive, and if that is so I shall hava to deal with you. The witness continued to give evidence, when Mr Rogers interrupted and said: “Just a moment, I didn’t hear that.’’ Witness repeated hie statement and Mr Rogers said: “.What is that you
said? I did not get all that.” The Crown Prosecutor made a halt in hi s examination of witness and His Honour said: “Go on. Mr Lusk." Mr Rogers: Wait on, witness, I want to get that down. When the Crown Prosecutor was proceeding -with his examination of the witness, Mr Rogers took exception to the manner of questioning and said: “Don’t lead the witness, Mr Lusk.” Crown Prosecutor: I am not leading him. For goodness sake let us be decent to each other, Mr Rogers.
