CURIOUS LEGAL POSITION.
MAXIMIM PENALTY IMI’OSI'.IJ. (Received 30. 1.5 p.m.) Adelaide, Male!'. 30. A curious position developed in the Criminal Court when four men were found guilty of robbery with violence. .Mr. Justice Parsons pointed out that the Act w hereunder the men wen* convicted. winch had boon amended last session, was paramount, it provided a maximum penalty of imprisonment for life and a minimum of three years’ hard labour with a whipping. In the Act as amended the words “or for any term not less than three years ' had been omitted. He. therefore, had no alternative but to inflict a lite sentence. The Crown Prosecutor said that tho omission of the words quoted was obviously a mistake, which should he brought under the notice of the Gov. vrnment. Mr. .Justice Parsons undertook to make the necessary recommendation regarding the punishment he would have inflicted had ho had discretionary power.
