APPLE APPEAL DISMISSED. London, March 26 The appeal in connection with brown heart in apples was dismissed by a majority with costs. Mr. Justice Bankes, in delivering the judgment, said there was no ground for imputing to the ship-owners any want of care, m reference to the provision for ventilation in the ships’ holds. There was evidence that the fruit had been left on the tree too long, and that might have had a material effect in producing susceptibility to disease. Air. Justice Scrutton concurred. Air. Justice Atkin differed, holding that the appellants had established beyond doubt that damage to the apples had occurred during transit.—(A. and N.Z.)
