THE OMAHU RE-HEARING.

Chief Judge Seth Smith yesterday delivered judgment in the Omahu rehearing case. The general impression among those interested is that the judgment leaves things very mnch as tbey wero before the appeal, so far as tbo principal parties are concerned. Broughtou's people retain tbeir settlement at Omahu, bat otherwise have not improved their position. The following is tbe text of tbe judgment .— We (.nd that the persons entitled under the several rights are in numbor ns follows .—Wiremina Ngahuka's people, 12 j William Brougbton's people, 69 j Airini Donnelly's people, 39. We havo determined to divide the land in the following order :— We define the interest of Wiremina Neahnka and her party as that part of the land at the western end of the block, containing 480 acres (Omabu I.), which ia bounded by a line drawn from the point where the Obiwia stream leaves the Rananga lake, then over the middle line of that stream nearest the Hnrimoana lake, and thence by a swinging lino drawn to the western boundary of the block so as to givo the required area, the residue of the boundary being the western boundary ot the block to tbe northern end ot tbe Runanga lake, and thence along the northern shore of the lake to the starting point. The residue of the block wo divide by a line drawn irom tbe north-west corner of Ihe Wnipiropiro btock to tbe Oinga lake at Hanhau. thence by n, straight line to the southern end of (he Kautnku lake ut its outlet, thence by a swinging line sneb that the area to tbe south (Omahu II.) shall contain 2500 acres. This portion we

award to Wi'liam Broughton and bipatty. The residue of the blook, which wr award to Airini Donnelly and her party, is estimated to contain 4420 acres. Of this we award 3430 (Omahu 111,1 to Ihnsr who derive their right from Te Kangikamangunu and Hawea, and 990 acrestOmahu IV.) to those who are entitled np Ngati Upokoirl. In estimating the area to which Wire mina Ngahukas party are entitled, wp havo included the interest of Hemi Kuku and Hohepa te Umurangl, which we deOne as 65 acres each. We have not yet defined the boundary between tbo two sections of Airini's party. Beforo doing so wo prefer to give the persons interested tbe opportunity of coming to on arrangement between themselves. We shall reserve that motter till to-morrow.
