A point of importance under the Imprisonment for Debt Abolition Act was decided by Mr Justice Richmond in the Supreme Court in Banco to-day. A .motion was made for a writ of prohibition restraining the Resident Magistrate at Gisborne and Mr Wilson, of the same place, hotelkeeper, from further enforcing an order .made by the said Resident Magistrate under the following circumstances :— On the 17th of August, ISB6, Wilson obtained judgment against John Robert Hurrey, of Makaraka (the nlain.tiff in the present case), in the Resident Magistrate's Court at Gisborne for the sum of £22 16s Od. On the 19th of August a judgment summons was issued against Hurrey in the Court below and duly served. At the hearing, objec- • lion was taken that defendant had A not been tendered his expenses to fk enable him to attend the Court, and thai there was no evidence to show that he had means to satisfy the debt: The Resident Magistrate overrnled the objections, and made an order for defendant to pay the amount claimed, with costs of witnesses' attendance, Court fees, and also solicitor's fee £2 2s, or in default to be imprisoned for 30 days. The grounds for the order of prohibition were that the Magistrate had exceeded his jurisdiction in ordering Hurrey to pay solicitor's fee ; and also that the order made by the Afagistrate was bad, as there was no evidence that Hurrey had means to pay the debt. Mr Edwards appeared in support of the motion, and asked his Honor to decide the point as to whether the Resident Magistrate had power to allow solicitor's fee m such a case before discussing the other point, which went into the merits of the case. After hearing argument of both counsel, his Honor decided that a prohibition order must bo granted on the ground urged by MiEdwards. It was not, therefore, necessary to decide the other point. At the settling to-night on the Wellington Racing Club's meeting the following were the principal amounts paid : — Hill, £152; Hoskins, £118 15s: Gentry, £95; Tailored, £85 10s. 'A rumor was circulated here to-day to the effect that Thomas Hall had burst a blood vessel and had dropped down dead in the Timaru Court-house. The rumor had no foundation in fact, and the excitement that it raised soon subsided. Timaru, Wednesday. • At the annual meeting to-day of the South Canterbury Charitable Aid Board Mr John Jackson was re-elected chairman. It was decided to take legal action against the Waimate Council for the recovery of the balance of that Council's contribution. D.unedin, Wednesday. At the inquest to-day on the lad Percy . Smith, who was killed by tailing from a cliff, a companion who was with deceased at the time stated that Smith had climbed a cliff from which ho had seen two birds ily, slipped, and fell.
