' r This is to certify that, having examined the Sheep owned by or in the charge of , >•; -JV - . who desires to drive or enter the said Sheep into the Province of Hawke's Bay, .^F 'hereby declare that the said Sheep are free from the disease called Scab, or any other contagious or infectious disease. ("Signed) ■ Inspector of Sheep, Province of Hawke's Bay. AN ACT to enable the Superintendent of the Province of Hawke's Bay to manage and administer, by Sale or Lease, certain Public Reserves. TXTHEREAS by virtue of the Reserves Act, 1854," the Governor of the » V Colony has, by a Grant dated the twenty-ninth day of December, 1860, sealed •with the public Seal of the Colony, granted to the Superintendent of the Province of Hawke's Bay certain parcels of Land in the Schedule to the said Grant, and also in the Schedule to this Act particularly described, in trust for the improvement of the Harbour of Napier and for the construction and maintenance of such Docks and other Works therein, as may be deemed advisable for facilitating the Trade and Commerce of the Town and Port of Napier aforesaid : And whereas it is expedient to make provision for the Management and Administration of such parcels of Land by lease or sale thereof : Be it therefore enacted by the Superintendent and Provincial Council of Hawke's Bay as follows : — 1. The Superintendent of the Province of Hawke's Bay, by and with the consent of his Executive Council, shall have full Power and Authority from time to time to demise and lease all or any part of the said parcels of Land comprised in the said Grant- for any term or terms of years not exceeding Twenty-one years, to take effect in possession at a reasonable rent or rents, without taking any fine or premium for the granting of the same, and subject to such terms and conditions as to the said Superintendent, with such consent as aforesaid, shall seem fit : Provided always that three months' notice be given by advertisement, to be inserted in the Provincial Gazette, of the intention of the Superintendent, with such consent as aforesaid to lease or demise all or any part of the said parcels of Land. 2. The Superintendent, by and with the consent of the Executive Council, shall have Power to sell and absolutely, dispose of all or any part of the Lands before mentioned. 3. All sales to be made by virtue of this Act to take place by Public Auction and absolutely. Three months' notice to be advertised in the Provincial Gazette previous to any such sale or sales. 4. The Superintendent, with the advice of his Executive Council, shall have Power to reserve for public purposes all or any part of the said parcels of Land,, oo THE SCHEDULE TO WHICH THE FOREGOING ACT REFERS. All that parcel of Land, be the same above or below high water mark, in the Province . of Hawke's Bay aforesaid, in our Colony of New Zealand, situate in the Harbour of Napier, and bounded towards the North by a line commencing at a point on the seaward face of Meanee Quay, in the Town of Napier, opposite to the South-eastermost angle of Alfred-street ; thence running Eastward along the seaward face of Meanee Quay aforesaid, and along the seaward 'boundaries of a Native Reserve and of a Government Reserve, and again along the seaward face of Meanee Quay to the Government Reserve at the Western Head of Port Napier ; thence along the seaward boundary of the said Reserve to its Easternmost point ; thence across the mouth of the Harbour to the Westernmost point of the Government Reserve at the Eastern Head ; thence along the seaward boundaries of the said Reserve and of the Town Sections numbered respectively five hundred and eighteen, five hundred and seventeen, and five hundred and sixteen, and of the Custom House Reserve ; thence across the seaward termination of a Public Road or Street and along the seaward boundaries of the Town Sections numbered respectively iive hundred and fifteen and five hundred and fourteen ; thence across the seaward termination of a Public Road or Street and along the seaward boundaries of the Town Sections numbered respectively five hundred and thirteen, the same being an Educational Reserve, and five hundred and twelve ; thence along the seaward face of Waghorne-street to the Western angle of the Town Section 3;l } mibei b ed five hundred ; thence along the seaward boundaries of the said Section of a Government Reserve and of the Town Sections numbered respectively four hundred and ninety-nine, four hundred and ninety-eight, four hundred and ninety-five, four hundred and ninety-three, four hundred and ninety-one, four hundred and eighty-nine, and four hundred and eighty-seven ; thence across the seaward termination of a Public Road or Street, and along the seaward boundaries of the Town Sections numbered respectively four hundred and eighty-five, four hundred and eighty-three, and four hundred and eightyone, to the North-eastern angle of the section last named ; thence across Waghornestreet, and along the Eastern boundary of the Town Section numbered four hundred and eighty ; thence along the side of the Hardinge-road to the Northeasternmost angle of the Town Section numbered four hundred and seventy ; thence along the Eastern boundary of the section last named, and the seaward boundary of the Town Section numbered four hundred and sixty-nine, the same being on Educational Reserve ; thence across Waghorne-street and along the seaward boundaries of the Town Section numbered four hundred and sixty-eight ; thence' across a public street or road, and along the seaward boundaries of the Town Sections numbered respectively four hundred and sixty-seven and four hundred, and sixty-six ; thence across Waghorne-street and along the seaward boundaries o£f|ie Town Section numbered four hundred and fifty-seven ; thence along the Hardinge-road to the Battery Reserve ; thence along the seaward boundaries of the said Battery Reserve to the commencement of the Battery-road, towards the East by the Battery-road aforesaid from the point last named to Battery Point ; thence by the Hyderabad-road to its junction with the Have-lock-road ; thence by the Wellesley-road to a point opposite to the South-westernmost angle of the Government Reserve, at the" Southern extremity of the Town of Napier • towards the South by a line bearing South, eighty-five degrees West, a distance of two miles and sixteen chains or thereabouts, to a point due South of the point of commencement ; and towards the West by a line bearing due North, a distance of one mile and twelve chains or thereabouts, to the point on Meanee Quay first above-named : Excepting always out of the said boundaries the Town -Sections situated upon Gough Island and numbered respectively five hundred and twenty-four to five hundred and thirty-seven, both inclusive : Also Public Reserve at the Northern extremity of the .said Island and the Public Roads or Streets called respectively Colin-street, Campbell-street, and Lucknow-street, as the said Lands and Harbour of. Napier are set forth on the pkur.'frL the before-mentioned Deed of Grant annexed, and therein defined by a red line.
