IThe Appeal Court is engaged in hearing the case of Alex Dunn, of Wellington, a solicitor, against Harry Mnndell, of Wellington, a seaman, which involves a point of law of great interest to mortgagees of property. Mandell was injured on the steamer Huia in 1920, and obtained judgment in Wellington in 1923 for £316, and against one Williams, the purchaser of a ship under an agreement Williams afterwards became bankrupt and left New Zealand. Dunn had three mortgages on the vessel amounting to £2200. The question arose as to whether Mandeb's claim took precedence over that of the mortagee’s and Judge Ostler found that it did. Against this decision Air. Dunn appeals. Air. Foden and Air. Barton ap_ pea red for the appellant and Air. Oregan for the respondent. Decision was reserved.
