CLAIM FOR DAMAGES.
ACTION AGAINST A COUNTY
COUNCIL
(BY TELEGRAPH PRESS ASSOCIATION.) CHRISTCHURCH, Nov. 26. Alleging that a temporary fence at a washout on a road was a hidden trap, Leo Stoddart, of Willowby, near Ashburton, a farmer, in the Supreme Court to-dav sued the Ashburton County Council for £2OOO damages in respect of the death of his wife. On the evening of August 18 Mrs. Stoddart drove a gig on the Alain South Road. At the southern approach to the Ashburton bridge she collided with a fence made of stakes and wire-netting, and was killed. It was claimed that the fence was not lighted, and that the council was negligent. The defence was that the accident was not, caused by the gig colliding with the fence, and that there was no negligence. The case is proceeding.
