X-RAY TREATMENT
ALLEGED NEGLIGENCE
JURY DISAGREES
(BY TELEGRAPH —PRESS ASSOCIATION.) AUCKLAND, Aug. 27. After a hearing lasting three days, the jury failed to agree in the re-trial at the Supreme Court of an action for damages in respect of injuries alleged to have been caused bv an X-ray burn.
When the action was originally heard, Peter Andrew Nairn Smith, a motor engineer, of Ponsonby, sought to recover. £BOO general and £250 special damages, and £IOO medical and hospital expenses from Dr. G. de Clive Lowe and August Brackebush, a professional masseur, alleging negligence in the application of the X-ray treatment. During the hearing Lowe was dismissed from the action, and the claim was then continued against Brackebush, the jury disagreeing. In the present action Smith claimed the same amount of damages against Brackebush on the ground -of alleged, negligent treatment. The defence was a general denial of the allegations.
