ALIEN WITH RADIO SET. (P.A.) AUCKLAND, July 25. Under Section 49F of the Aliens Emergency Regulations, 1940, Heinz Isadore Rosenberg, 21, was charged in the Police Court that, being an enemy alien, he had in his possession a radio set, for which a written permit had not been granted by the registration officer. Kennetn Royce Russell was charged with aiding, counselling, or procuring icosenberg in the commission of that offence. Both defendants pleaded not guilty, but admitted the facts. The police said that nosenberg had a radio set for which a permit had been granted. This set was sealed so that it would not receive shortwave communications. On June 25, Russell left him another set, for trial. This was not sealed, and the police four days later visited his home and took possession of the set. Counsel for Rosenberg Submitted that there was no offence, because Mrs Rosenberg, who was an Auckland girl, had been exempted by the Minister of Justice from the provisions of the regulations, and that she owned the house where defendant resided, and the radio set. Counsel said there was no harm in Rosenberg, who was a perfectly loyal man, and for a time was in uniform. Counsel for Russell submitted that no offence was disclosed, as he had intended to have the second set sealed if Rosenberg had decided to retain it. The set was merely on approval. In fining each defendant £5, Mr Hunt, S.M., said he was satisfied there was nothing sinister about tne matter, otherwise he would not have imposed such a modest fine.
