ACCOUNTANT SUED.

CLAIM FOR £5OO SUCCEEDS. CHRISTCHURCH, December 10. In the Supreme Court, the Dominion Trust Coy, of New Zealand, Ltd., J. V. Jameson, company manager, and C. G. McKellar, accountant and shareholder, proceeded against Jas. Stephen Day, public accountant, for £5OO. alleged to be due to the estate of the late Rich-, ard Heward, farmer. It was alleged that ri December, 1927. Day, as syndic for the Company. obtained letters of administration of Hayward’s estate. In August. 1928, Day was discharged from th? position of administrator, and Jameson and McKellar were appointed. Day sold certain bonds belonging to Heyward without repaying the money, and received £5OO. Day alleged that he sold the bonds on Heyward’s instructions: that Heyward lent him the money; that he gave Heyward a promissory note for the sum, and that Heyward destroyed the note, making a present of £5OO to Day. Mr Justice Adams said he was not Ratified that Day’s story was proved. It left on his mind a strong impression that no such arrangement had Keea made. Judgment was given for plaintiff on the claim, with costs. • Day counterclaimed for £6OO for ser vices to Heyward. Judgment was given against him on this also.
