MEDICAL CERTIFICATE DUNEDIN, April 9. In the Magistrate’s Court to-day, Robert Findlay Allan, medical practioner, was charged with supplying incorrect or misleading particulars relating to an application by- Philip Idour for a motor driver’s license!-It was alleged that in support of his application Idour submitted a certificate given by Dr Allan, who had examined him on October 2 for the purpose of manpower requirements, to the effect that he had cardiac disease and was not fit for heavy work. At the same time he produced a later certificate from Dr. Allan which stated that pulsations of the heart were natural and the sounds those of health. ’ ’ ' After considerable evidence had been heard, counsel for the defence submitted that a prosecution would not lie in law because the. opinion given was defendant’s opinion, and no matter how unsound it might be, it was his opinion and removed from misrepresentation. < .
