MILLINER’S CLAIM SUCCEEDS [PEB PBESS ASSOCIATION.] WELLINGTON, April 17. Arising from the destruction of a motor-lorry and its freight, by fire, on the Masterton-Wellington highway, in September last, a three-cornered dispute was heard before Mr. E. Page, S.M., to-day. Alice Eeles, trading as tlie New Zealand Millinery Supplies, sued the Wellington Express Company for hats valued at £lOl/11/-, that were destroyed in the blaze, and damages caused by the company s delay in paying the amount claimed. The Wellington Express Coy. sued the Phoenix Assurance Coy. for £172/

17/6, the goods on the lorry being covered by an open policy with the Assurance Company, and the owners of the goods having called on the Express Coy. to pay their value. Mr. Page gave judgment for plaintiff Eeles, with £2/10/- added for interest. He reserved his decision in the case as between the Wellington Express Coy. and the Phoenix Assurance Company.
