SYDNEY, August 27.

The Full Court is hearing the application for a rule nisi against the “Sydney Morning Herald,” in connection with its editorial reference to the arrest of Union leaders arising out of the timber strike. - Affidavits were tendered by the editorial writers. In these they claim their comments in connection with the timber strike, which is the subject of complaint, related to bona fide reports, and that the- reference made to a “basher” gang were not intended to apply to Mr. Garden or the other arrested Union leaders, whose cases were before the courts. They claimed that the timber strike was so important from a public standpoint that continuous references to it were considered necessary. The statements in their reports and articles were published from a sense of duty.
